Legal Sports Betting in West Virginia
Legal online and retail sports betting was legalized in West Virginia in 2018 when Delegate Shawn Fluharty introduced two sports wagering bills to the West Virginia Legislature. While both of these measures failed to pass, a more comprehensive bill, SB 415, a much more comprehensive act, passed the House and Senate.
This act introduced licensing for sports betting in WV. Each of the state’s five casinos became eligible for licensing, allowing the casino to offer retail and up to three online sportsbook skins each. Initial applications are subject to a $250,000 fee, with each renewal costing $100,000. Operators must also pay a tax of 10% on all revenue.
SB 415 made the West Virginia Lottery the regulator of WV sportsbooks. West Virginia Lottery oversees all sportsbooks, sets standards, and enforces regulations on sports betting.
West Virginia’s Legal Sports Betting Age
West Virginia betting law indicates that those aged over 21 years can bet at retail and online sportsbooks. To comply with state sports betting legislation, sportsbooks must verify the age of players by asking them to provide a copy of their photo ID while registering.
Additionally, those linked to a sports organization, such as players, coaches, and referees, are prohibited from betting on sports. Likewise, those with a history of criminal activity, particularly those related to gambling and sporting integrity, are barred from betting.
Paying Tax on Sports Betting Winnings in West Virginia
West Virginia classifies sports betting winnings as taxable income. The state’s income tax rate is 6.5%, and West Virginia sports betting law requires the state lottery to withhold 6.5% of all taxable winnings over $5,000 if identification is not provided.
In addition to this, you will need to pay federal tax on sports betting winnings over $600. Your sportsbook should provide you with a W-2G Form, which can be supplied to the IRS for your tax return.
History of Sports Betting Bills in West Virginia
Interest in sports wagering in West Virginia has been high for some time, and the state even passed sports betting legislation before the repeal of the Professional and Amateur Sports Protection Act (PASPA) in May 2018.
The WV Sports Wagering Act was passed in March 2018. Governor Jim Justice opposed the act but allowed it to become law without his signature. The final sports betting bill was passed in April 2022, with esports betting becoming legal.
2022
- HB 4826 – West Virginia Lawmakers, including Delegate Shawn Fluharty and Moore Capito, pass an act to legalize wagering on esports.
2018
- West Virginia Sports Wagering Act – A group of lawmakers pass legislation to legalize sports betting through the state’s casinos. Each casino is allocated three online sportsbook licenses, with operators paying a license fee and a 10% tax on revenues. Governor Jim Justice does not sign the bill but it still becomes law.
2017
- HB 2751 – Delegate Shawn Fluharty introduces a bill to legalize and regulate sports wagering at West Virginia casinos through an amendment to the constitution. The bill fails to win lawmakers’ support.

- Moneyline: If you choose to place a moneyline bet, you are betting on the winner of a sport or event.
- Point Spread: A point spread bet aims to even the playing field between two teams in a game. Sportsbooks can offer higher payouts and rewards when both teams attract equal betting. For example, with a 4-point spread, the favorite team must win by more than four points for you to win your bet.

- Same Game Parlays (SGP): As the name suggests, parlays allow you to combine multiple bets from the same game or sporting event on the same betting slip. For example, you could place a moneyline bet for the winner but additional total bets if you want to predict the final score.

West Virginia Lottery Bets
West Virginia Lottery is the regulator of sports betting in the state. It does not operate a sportsbook in the Mountaineer State, and you cannot place bets at lottery retailers. As it is the regulator of sports betting, we do not expect wagering to become available at lottery retailers in the future.
West Virginia DFS
West Virginia bettors have been able to play daily fantasy sports legally since 2016 when the state Attorney General issued the opinion that state law interpreted DFS as a game of skill, rather than chance.
